 Worker Registration Scheme Update
The Government has laid before Parliament the Accession (Immigration and Worker Registration) (Revokation Savings and Consequential Provisions) Regulations 2011 which will end the Worker Registration Scheme from 1 May 2011.

Under the terms of Treaty of Accession, the UK may no longer apply transitional measures in respect of access to the labour market to nationals of the Member States that acceded to the European Union in 2044 (‘A8 nationals’) beyond 30 April 2011. A8 nationals will be free to take employment in the UK, and enjoy a right to reside on that basis, without being subject to the existing requirement to register their employment. Employers will cease to be subject to a requirement to ensure that A8 nationals in their employment have applied for registration under the Scheme.

The Regulations make transitional provision concerning how those still subject to the registration requirement on 30 April 2011, are to be treated for the purpose of the Immigration (European Economic Area) Regulations 2006. These regulate the right of entry and residence in the UK of nationals of States of the European Economic Area and Switzerland.

The Worker Registration Scheme remains in force until 30 April 2011. The design of the scheme means that those subject to the registration requirement but who do not commence their employment until on or after 1 April 2011 will not be required to submit an application. Where the UK Border Agency continues to receive applications under the Scheme up to and including 30 April, it will process those applications. It will cease to accept applications under the Scheme from 1 May 2011.
